Tupac Shakur\u2019s estate is none too happy about Drake cloning the late hip-hop legend\u2019s voice in a Kendrick Lamar diss track. Billboard<\/em> reported<\/a> Wednesday that attorney Howard King, representing Mr. Shakur\u2019s estate, sent a cease-and-desist letter calling Drake\u2019s use of Shakur\u2019s voice \u201ca flagrant violation of Tupac\u2019s publicity and the estate\u2019s legal rights.\u201d<\/p>\n Drake (Aubrey Drake Graham) dropped<\/a> the diss track \u201cTaylor Made Freestyle\u201d last Friday, the latest chapter of the artist\u2019s simmering decade-long feud<\/a> with Pulitzer and 17-time Grammy award winner Kendrick Lamar.<\/p>\n \u201cKendrick, we need ya, the West Coast savior \/ Engraving your name in some hip-hop history,\u201d an AI-generated 2Pac recreation raps in Drake\u2019s track. \u201cIf you deal with this viciously \/ You seem a little nervous about all the publicity.\u201d<\/p>\n Representing Shakur\u2019s estate, King wrote in the cease-and-desist letter that Drake has less than 24 hours to pull down \u201cTaylor Made Freestyle,\u201d or the estate would \u201cpursue all of its legal remedies\u201d to force the Canadian rapper\u2019s hand. \u201cThe unauthorized, equally dismaying use of Tupac\u2019s voice against Kendrick Lamar, a good friend to the Estate who has given nothing but respect to Tupac and his legacy publicly and privately, compounds the insult,\u201d King wrote, according to Billboard<\/em>.<\/p>\n \u201cThe Estate is deeply dismayed and disappointed by your unauthorized use of Tupac\u2019s voice and personality,\u201d King wrote. \u201cNot only is the record a flagrant violation of Tupac\u2019s publicity and the estate\u2019s legal rights, it is also a blatant abuse of the legacy of one of the greatest hip-hop artists of all time. The Estate would never have given its approval for this use.\u201d<\/p>\n \u201cTaylor Made Freestyle\u201d also used AI to clone Snoop Dogg\u2019s voice, with Drake using digital clones of two of Lamar\u2019s west-coast hip-hop influences to try to hit him where it hurts. In a video posted to social media the following day, Snoop didn\u2019t appear<\/a> to know about the track. \u201cThey did what? When? How? Are you sure?\u201d, the 16-time Grammy nominee and herb connoisseur said. \u201cWhy everybody calling my phone, blowing me up? What the fuck? What happened? What’s going on? I’m going back to bed. Good night,\u201d he continued.<\/p>\n Engadget emailed Snoop Dogg\u2019s management to ask about his thoughts on Drake cloning his voice. At the time of publication, we hadn\u2019t heard back.<\/p>\n The saga contains more than a bit of irony \u2014 if not outright hypocrisy \u2014 from Universal Music Group (UMG), the label representing Drake. You may remember the track \u201cHeart on My Sleeve\u201d by \u201cGhostwriter977,\u201d which briefly went viral last year<\/a>. It was pulled after UMG complained to streaming services because it used an AI-generated version of Drake\u2019s voice (along with The Weeknd).<\/p>\n Engadget asked UMG if it approved of Drake\u2019s use of AI-generated voices in \u201cTaylor Made Freestyle\u201d and where it stands on the broader issue of using artists\u2019 digital clones. We haven\u2019t received a comment at press time. Without a clear explanation, it\u2019s hard not to see the label as being on the side of whatever seems most financially advantageous to it at any particular moment (surprise!).<\/p>\n Laws addressing AI-cloned voices of public figures are still in flux. Billboard<\/em> notes that federal copyrights don\u2019t clearly cover the issue since AI-generated vocals typically don\u2019t use specific words or music from the original artist. Mr. King, speaking for Shakur\u2019s estate, believes they violate California\u2019s existing publicity rights laws. He described Drake\u2019s use of Shakur\u2019s voice as forming the \u201cfalse impression that the estate and Tupac promote or endorse the lyrics for the sound-alike.\u201d<\/p>\n Last month, Tennessee passed<\/a> the ELVIS (\u201cEnsuring Likeness Voice and Image Security\u201d) Act to protect artists from unauthorized AI voice clones. The \u201cfirst-of-its-kind legislation\u201d makes copying a musician\u2019s voice without consent a criminal Class A misdemeanor.<\/p>\n But none of the parties involved in this feud are in Tennessee. On the federal level, things are moving much more slowly, leaving room for legal uncertainty. In January, bipartisan US House legislators introduced<\/a> the No Artificial Intelligence Fake Replicas And Unauthorized Duplications Act (\u201cNo AI FRAUD\u201d), putting cloned voices like those Drake used in the government\u2019s crosshairs. Congress hasn\u2019t taken any public action on the bill in the more than three months since.<\/p>\n \u201cIt is hard to believe that [Tupac\u2019s record label]\u2019s intellectual property was not scraped to create the fake Tupac AI on the Record,\u201d King wrote in the cease-and-desist letter.
