Another day, another company tests Apple's resolve. This time, it's TikTok allegedly violating the company's rules for apps, with the video platform seemingly allowing some users to purchase its coins directly from its website. TikTok has apparently given some iOS users the option to "Try recharging on tiktok.com to avoid in-app service fees" — namely Apple's 30 percent commission on purchases.

According to photos shared on X (formerly Twitter) by David Tesler, co-founder of the app Sendit, TikTok is prompting users to save around 25 percent when purchasing coins (used to tip creators) thanks to lower third-party service fees. They can then use Apple Pay, PayPal or a credit or debit card to complete their transaction. It's unclear why only some users have access to this circumnavigation; one hypothesis is the feature was turned on for individuals who previously purchased a large number of coins.

Apple notably kicked Fortnite off its app store in 2020 after Epic Games introduced discounts on the game's currency for anyone who directly purchased it. The incident set off a multi-year legal battle, with Apple reinstating Epic Games' developer account in March after the European Union began looking into the situation. More recently, Apple has faced pushback from Spotify and rejected updates that would have displayed the music streamer's pricing and allowed in-app plan purchases.

TikTok and Universal Music Group (UMG) have signed a deal that will allow Taylor Swift, Olivia Rodrigo, The Weeknd and other artists to return to the platform, the companies announced in a press release. Universal pulled songs from its roster of performers back in February and with some exceptions, its music hasn't been there since. Both sides are now "working expeditiously" to get content back on the platform that's home to a billion-plus users.

A key part of the deal is artist protection from generative AI. "TikTok and UMG will work together to ensure AI development across the music industry will protect human artistry and the economics that flow to those artists and songwriters," the companies wrote. "TikTok is also committed to working with UMG to remove unauthorized AI-generated music from the platform, as well as tools to improve artist and songwriter attribution."

Also part of the deal are "new monetization opportunities" from TikTok's recent expansion into e-commerce. TikTok will reportedly also assist artists by providing tools around analytics, integrated ticketing, an "Add to Music App" and more.

Universal took the drastic move of pulling music earlier this year, forcing the platform to mute videos or replace tracks with options from other labels. "As our negotiations continued, TikTok attempted to bully us into accepting a deal worth less than the previous deal, far less than fair market value and not reflective of their exponential growth," UMG said at the time.

Last month, Taylor Swift's songs returned to TikTok, likely because she has full control of her own catalogue and was able to strike a separate deal. Some songs by other UMG artists, including Ariana Grande, also started appearing on the platform.

The dispute appears to be water under the bridge, but it's the least of TikTok's problems at the moment. US Congress recently voted in favor of a bill that would see TikTok banned in a year unless owner ByteDance sells the app.

The European Union (EU) has opened a second formal investigation into TikTok and has accused the platform of running afoul of the region’s Digital Services Act (DSA), according to a report by TechCrunch. The probe involves the addictive nature of TikTok Lite, which is a smaller version of the app that takes up less memory on a smartphone and was built to perform over slower internet connections.

TikTok Lite launched earlier this month in France and Spain and includes a design aspect that allows users to earn points by watching and liking videos. These points can be exchanged for stuff like Amazon vouchers and TikTok’s proprietary digital currency, which is typically used to tip creators. The EU’s Commission has expressed concern that this type of "task and reward" design language could impact the mental health of young users by "stimulating addictive behavior.”

The Commission hasn’t yet confirmed any breaches of the DSA, but has suggested that it might impose temporary measures to force parent company ByteDance to suspend TikTok Lite in the EU while it continues the investigation. The company has until April 24 to argue against these potential measures, so the app’s still available for EU residents. However, ByteDance failed to provide the EU with a risk assessment document regarding TikTok Lite after being asked last week.

This failure to comply with the DSA could open the company up to steep penalties of up to one percent of its total annual income and periodic penalties of up to five percent of daily income. The Commission hasn’t indicated if it plans on issuing these fines as the investigation continues.

"We suspect TikTok Lite could be as toxic and addictive as” light cigarettes, Thierry Breton, the commissioner for the EU Internal Market, wrote in a press release announcing the probe. “We will spare no effort to protect our children."

ByteDance has yet to respond to the investigation and the potential of TikTok Lite being banned in the EU. This latest inquiry follows a more comprehensive probe issued back in February. That wide-ranging investigation focuses on addictive algorithms, age verification issues, default privacy settings and ad transparency.

February’s probe is ongoing, but ByteDance was already forced to make concessions to allow TikTok to operate in the EU. The company had to give users the choice to disallow algorithms from powering the For You Page and instituted new harmful content reporting options. It also suspended personalized ads for EU users aged 13 to 17.

As for America, the controversial TikTok ban keeps inching closer to reality. The US House of Representatives tucked a revised version of the bill into this weekend’s foreign aid package. Under this new proposed legislation, ByteDance would have one year to sell off TikTok before it would be banned from app stores. It’s now heading to the Senate and will likely be voted on this week. However, it remains to be seen if the Senate will even keep the stuff about TikTok in the foreign aid package. President Biden has previously said he would support a TikTok ban if Congress passes it.

A bill that could ban TikTok is now all but certain to become law. The Senate approved a measure that requires ByteDance to sell TikTok or face a ban, in a vote of 79 – 18. A package of bills that includes the “Protecting Americans from Foreign Adversary Controlled Applications Act,” will next head to President Joe Biden, who has said he would sign the legislation into law.

While it’s far from the first effort to force a ban or divestment of the social media app, the bill managed to draw far more support than previous attempts. The bill was introduced in March and sailed through the House of Representatives with overwhelming bipartisan agreement. A slightly revised version was approved as part of a package of foreign aid legislation on Saturday.

Under the updated terms, TikTok would have up to 12 months to divest from parent company ByteDance or face a ban in US app stores and web hosting services. The company has called the bill unconstitutional and indicated it would mount a legal challenge to such a law, which could further delay an eventual sale or ban.

The company didn’t immediately respond to a request for comment.

TikTok has long been viewed with suspicion by lawmakers and the intelligence community. Ahead of votes in the House and Senate, members of Congress were briefed by intelligence officials on the alleged national security threat posed by the app. The exact nature of those concerns is still unclear, though some members of Congress have asked for details from the briefings to be declassified.

At the same time, some lawmakers have expressed skepticism, saying that the alleged threat posed by TikTok is largely hypothetical. Free speech and digital rights groups also oppose the bill, noting that comprehensive privacy legislation would be a more effective way of protecting Americans’ personal data. TikTok CEO Shou Chew has made a similar argument, telling Congress last year that a forced sale wouldn’t resolve data concerns about the app.

But TikTok’s recent efforts to muster opposition to the bill may have backfired. Lawmakers rebuked the company for sending in-app notifications to users about the bill after the alerts resulted in a flood of calls to Congressional offices. And the app may have drawn even more suspicion when Politico reported last week that Chinese diplomats were lobbying Congressional staffers to oppose the bill. Officials in China have condemned the measure. A Chinese law, passed in 2020, could prevent ByteDance from including TikTok’s recommendation algorithm in a sale of the app.

The bill that will force a sale or ban of TikTok in the United States is now law. President Joe Biden signed a package of foreign aid bills that included the “Protecting Americans from Foreign Adversary Controlled Applications Act,” one day after the legislation was approved by the Senate.

In a statement, TikTok said it would challenge the law in court, which could delay an eventual sale or ban. “This unconstitutional law is a TikTok ban, and we will challenge it in court,” the company said. “We believe the facts and the law are clearly on our side, and we will ultimately prevail. The fact is, we have invested billions of dollars to keep U.S. data safe and our platform free from outside influence and manipulation. This ban would devastate seven million businesses and silence 170 million Americans.”

The law gives TikTok’s parent company ByteDance, which is based in China, up to a year to sell the app to a new owner. If the company fails to divest, then TikTok will be banned from US app stores and web hosting services.

Unlike previous attempts to force a sale or ban of the app, the “Protecting Americans from Foreign Adversary Controlled Applications Act,” had overwhelming bipartisan support and was able to move through Congress with remarkable speed. The original version of the bill, which called for a six-month window to divest, passed the House in March, just days after it was introduced. An updated version, which allows up to 12 months for a divestment, passed over the weekend.

In a video shared on TikTok, CEO Shou Chew called it a “disappointing moment” for the company. “Make no mistake, this is a ban on TikTok and a ban on you and your voice,” he said. “It's actually ironic because the freedom of expression on TikTok reflects the same American values that make the United States a beacon of freedom.”

The EU has effectively vanquished a TikTok feature that Europe’s digital commissioner described as “toxic” and “addictive as cigarettes.” Owner ByteDance said on Wednesday that TikTok Lite’s reward-to-watch feature would be suspended. It’s been a brutal day for TikTok as President Biden signed a bill (also on Wednesday) forcing ByteDance to sell the platform’s US operations or face a ban.

TikTok Lite, launched earlier this month in France and Spain, lets users earn rewards by watching and liking videos. They can then exchange their points for real-world perks like Amazon vouchers or in-app ones like TikTok’s virtual currency, which is used to tip creators. The EU Commission said the “task and reward” feature can stimulate “addictive behavior” in children.

“Our children are not guinea pigs for social media,” EU commissioner Thierry Breton posted on X (Twitter) on Wednesday. “I take note of TikTok’s decision to suspend the #TikTokLite ‘Reward Program’ in the EU.”

However, he added a parting shot to remind ByteDance it isn’t out of the woods: “The cases against TikTok on the risk of addictiveness of the platform continue.”

Breton fired a warning shot at ByteDance earlier this week, saying the EU had opened a formal investigation into TikTok for violating the Digital Services Act (DSA). The landmark legislation, adopted in 2022, gives European regulators the teeth to force significant changes in social media platforms to protect consumers.

Companies that break the rules can risk fines of up to six percent of their global revenues — enough to force compliance from even the richest companies. Wednesday’s suspension marks the first concrete example of the EU using the DSA’s enforcement powers to force significant changes on a social platform.

The EU’s formal investigation into TikTok Lite was its second targeting the platform this year. An earlier case, launched in February, opened proceedings against TikTok and Meta for their handling of the privacy and safety of minors. The Guardian notes that both cases remain active.

“TikTok always seeks to engage constructively with the EU Commission and other regulators,” the platform’s Policy Europe X account posted on Wednesday. “We are therefore voluntarily suspending the rewards functions in TikTok Lite while we address the concerns that they have raised.”

The US House of Representatives passed a bill on Saturday that could either see TikTok banned in the country or force its sale. A revised version of the bill, which previously passed the House in March but later stalled in Senate, was roped in with a foreign aid package this time around, likely meaning it will now be treated as a higher priority item. The bill originally gave TikTok’s Chinese parent company, ByteDance, six months to sell the app if it’s passed into law or TikTok would be banned from US app stores. Under the revised version, ByteDance would have up to a year to divest.

The bill passed with a vote of 360-58 in the House, according to AP. It’ll now move on to the Senate, which could vote on it in just a matter of days. Senate Majority Leader Chuck Schumer said today that the Senate is working to reach an agreement on when the next vote will be for the foreign aid package that the TikTok bill is attached to, but it is expected to happen this coming Tuesday. President Joe Biden has previously said he would support the bill if Congress passes it.

The bill paints TikTok as a national security threat due to its ties to China. There are roughly 170 million US users on the app, at least according to TikTok, and ByteDance isn’t expected to let them go without a fight. In a statement posted on X earlier this week, the TikTok Policy account said such a law would “trample the free speech rights” of these users, “devastate 7 million businesses, and shutter a platform that contributes $24 billion to the U.S. economy, annually.” Critics of the bill have also argued that banning TikTok would do little in the way of actually protecting Americans’ data.

TikTok is ramping up penalties for creators who post potentially “problematic” content and tightening its rules around what can be recommended in the app. The updates arrive as TikTok is fighting for its future in the United States and trying to convince lawmakers and regulators that its app is safe for teens.

Under its updated community guidelines, set to take effect in May, TikTok has added a long list of content that’s not eligible to be recommended in the app’s coveted “For You” feed. The list includes some obvious categories, like sexually suggestive or violent content, but it also adds topics that have previously been a source of controversy for the app. For example, the new guidelines bar videos showing “dangerous activity and challenges,” as well as many types of weight loss or dieting content. It also prohibits any clips from users under the age of 16 from appearing in “For You.”

There’s also a lengthy section dedicated to a wide range of misinformation and conspiratorial content. From the guidelines:

In addition to the eligibility changes, TikTok says it will also begin to penalize creators who repeatedly disregard this guidance by making their entire account ineligible for recommendations, not just the specific offending posts. The company will also make their account “harder to find” in search.

Additionally, the app is getting a new “account status” feature, which will help users track if they are running afoul of these rules. Much like the feature of the same name in Instagram, TikTok’s account status will alert creators to strikes on their account and posts that run afoul of the app’s rules. And an “account check” feature will allow users to track if they are currently being blocked from recommendations or otherwise unable to access features like messaging or commenting as a result of breaking the app’s rules.

TikTok is experimenting with an all-new app that’s just for sharing photos with text updates. It’s called TikTok Notes, and it’s available now in Australia and Canada.

“We’re in the early stages of experimenting with a dedicated space for photo and text content with TikTok Notes,” the company wrote in an update on X. “We hope that the TikTok community will use TikTok Notes to continue sharing their moments through photo posts. Whether documenting adventures, expressing creativity, or simply sharing snapshots of one’s day, the TikTok Notes experience is designed for those who would like to share and engage through photo content.”

Based on App Store screenshots, it appears the app will, like TikTok, have two feeds: a “for you” timeline of recommended content as well as a “following” feed. Posts appear to be very similar to what you’d see scrolling Instagram (before TikTok-like video took over the app, anyway): single images or carousels of multiple photos with lengthy captions.

Rumors of the Instagram-like app have been swirling for the last month as reverse engineers unearthed references in TikTok’s code. Some TikTok users had also seen in-app notifications about the new service in recent days.

It’s an interesting moment for TikTok to try to take on Instagram’s central feature. Having a photo-focused app gives TikTok users a new place to share non-video content and potentially reach their existing audience. The company is also facing the possibility its main app could be banned or drawn into a lengthy legal fight in the United States, so having an alternative app could help it maintain users in the country (TikTok hasn’t said when Notes might be available in the US.)

It also comes at a time when many Instagram users are frustrated with Meta about the reach of their feed posts. Instagram’s top exec Adam Mosseri regularly responds to frustrated creators on Threads about why their feed posts don’t seem to reach as many followers as they used to. If TikTok Notes takes off, those creators may actually have a viable alternative for posting photos.
