The justices denied Musk’s petition without commenting. Their unwillingness to take up the billionaire’s appeal leaves intact an appeals court ruling from a year ago that smacked down the Tesla founder’s claims of victimhood.

The saga began in 2018 when Musk tweeted, “Am considering taking Tesla private at $420. Funding secured.” He also posted, “Investor support is confirmed. Only reason why this is not certain is that it’s contingent on a shareholder vote.” Tesla’s stock rose by more than six percent.

There was only one tiny problem: The funding wasn’t secured, and the SEC takes false statements that affect investors very seriously. The SEC said, “Musk had not even discussed, much less confirmed, key deal terms, including price, with any potential funding source” and that he “knew that he had not satisfied numerous additional contingencies.” The government agency claimed the post caused “significant confusion and disruption in the market for Tesla’s stock.”

The SEC settlement hit his wallet hard, requiring Musk and Tesla to each pay $20 million in penalties. He also had to step down from his board chairman role at the automaker and have a Tesla attorney screen any investor-related tweets before posting. Of course, Musk later bought Twitter and changed its name to X. But at least that’s going splendidly!

His appeal said the settlement forced him to “waive his First Amendment rights to speak on matters ranging far beyond the charged violations.” Musk, who currently has an estimated net worth of $185 billion, claimed he was a victim of “economic duress” when agreeing to the settlement, which he described as a tactic to “muzzle and harass” him and his company.

The 2nd Circuit appeals court, whose ruling will now be the final word on the matter, shot down Musk’s arguments. “Parties entering into consent decrees may voluntarily waive their First Amendment and other rights,” they said. The appeals court saw “no evidence to support Musk’s contention that the SEC has used the consent decree to conduct bad-faith, harassing investigations of his protected speech.”

Instead, X is tweaking the visibility of replies in the context of a block. Previously, a user could block someone on X and still reply to their posts. And the person who was blocked wouldn’t be able to view that reply or know the person who had blocked them was engaging with their posts. That’s now being rolled back so that users will be able to see direct replies even if the person posting has blocked them. In a post from X’s engineering team, the company said the change is “part of our ongoing commitment to aligning the block feature with our principles as a public town square.”

The post also hinted that there may be more changes coming to blocks, which is one of the most widely used safety features on the service. “Our goal is to allow users to control their experience while maintaining the public visibility of posts,” the company said. That would seem to align with previous comments from Musk, who has said on multiple occasions that a public-facing “block” feature “makes no sense” and that “block is going to be deleted as a ‘feature,’ except for DMs.”

For now, the changes to blocking aren’t that drastic. In fact, they may even be welcomed by some users who want more visibility into what people are saying about them on the platform. But the fact that X is starting to change the visibility of previously blocked content could also be a sign of more significant changes to come.

According to X, Grok relies on users’ posts to generate the text snippets. Some seem to be more news-focused, while others are summaries of conversations happening on the platform itself. One user posted a screenshot that showed stories about Apple’s earnings report and aid to Ukraine, as well as one for “Musk, Experts Debate National Debt,” which was a summary of a “candid online discussion” between Musk and other “prominent figures” on X.

If any of this sounds familiar, it’s also remarkably similar to Moments, the longtime Twitter feature that curated authoritative tweets about important news and cultural moments on the platform. The feature, which was overseen by a team of human staffers, was killed in 2022.

Like other generative AI tools, Grok’s summaries come with a disclaimer. “This story is a summary of posts on X and may evolve over time,” it says. “Grok can make mistakes, verify its outputs.” Grok, of course, doesn’t exactly have the best track record when it comes to accurately interpreting current events. It previously generated a bizarre story suggesting that NBA player Klay Thompson went on a “vandalism spree” because it couldn’t understand what “throwing bricks” meant in the context of a basketball game.

X CEO and marketing robot Linda Yaccarino promises “real-time” content and wide availability, but other than that details are scanter than scant. There’s some corporate speak nonsense about AI, of course, and boasts about “effortless casting” from a mobile device to a TV. Wait, I thought this was a TV app? So it’s also a mobile app that casts to a TV? Is there another word for less than half-baked? Does raw work?

In other words, we don’t know much. This is X. All we get are word salads that don’t really mean anything and then, one day, the app may or may not actually appear. If it does, it’s likely to be hopelessly broken. That sounds harsh, but there’s plenty of proof-laden pudding to go around. We got receipts.

Back when Twitter first rebranded to X, the company promised the whole thing would soon be “powered by AI.” X eventually did create a chatbot, Grok, but it’s not exactly the sharpest algo in the shed. It also doesn’t look to be “powering” the site anytime soon. Elon Musk promised that X would soon become a payments and banking platform, which thankfully hasn’t materialized. Remember when Musk said that all major X decisions would be conducted via user poll? When was the last time you’ve seen one of those? There’s also the whole ongoing blue check fiasco.

The long-promised job search tool did launch, but it’s just kind of crappy. X did pursue original video content for a while, but things seem to have cooled off ever since the Don Lemon/Elon Musk debacle. Two years after Musk purchased the site, it’s still far from being the “everything app.”

There’s also the question of what kind of content will be streaming on this platform. Again, this is X. I’m just not sure how many people want to sit on their living room couch and watch a guy scream into the void about how the video game site Kotaku is ruining American society. The ad spotlights Carlson, as mentioned above, which indicates an endless stream of videos of people complaining about the word woke without actually defining it. Call me crazy, but I’d rather watch actual TV.

Heck. Even if I wanted to watch a vlog of impotent rage, YouTube is right there. It’s on smart TVs now and it works just fine. It has everything Yaccarino promises that one day will come to X TV. Plus, YouTube can teach you stuff, beyond how to block folks with a blue check next to their name.

X TV may or may not release in the near or far future on some or all smart TVs. It may be an actual app on the TV or an app on a phone that casts to a TV. It may be powered by AI, or not. It may have “tailored search” or it may just show you endless loops of Jordan Peterson bursting into tears. Who the heck knows. Be on the lookout for this latest pivot to video… or not.

However, the NHTSA also found that “Tesla’s weak driver engagement system was not appropriate for Autopilot’s permissive operating capabilities.” In other words, the software didn’t prioritize driver attentiveness. Riders using Autopilot or the company’s Full Self-Driving technology “were not sufficiently engaged,” because Tesla “did not adequately ensure that drivers maintained their attention on the driving task."

The organization investigated nearly 1,000 crashes from January of 2018 until August of 2023, accounting for 29 total deaths. The NHTSA found that there was “insufficient data to make an assessment” for around half (489) of these crashes. In some incidents, the other party was at fault or the Tesla drivers weren’t using the Autopilot system.

The most serious were 211 crashes in which “the frontal plane of the Tesla struck a vehicle or obstacle in its path” and these were often linked to Autopilot or FSD. These incidents led to 14 deaths and 49 serious injuries. The agency found that drivers had enough time to react, but didn’t, in 78 of these incidents. These drivers failed to brake or steer to avoid the hazard, despite having at least five seconds to make a move.

That’s where complaints against the software come into play. The NHTSA says that drivers would simply become too complacent, assuming that the system would handle any hazards. When it came time to react, it was too late. “Crashes with no or late evasive action attempted by the driver were found across all Tesla hardware versions and crash circumstances,” the organization wrote. The imbalance between driver expectation and the operating capabilities of Autopilot resulted in a “critical safety gap” that led to “foreseeable misuse and avoidable crashes.”

The NHTSA also took umbrage with the branding of Autopilot, calling it misleading and suggesting that it lets drivers assume the software has total control. To that end, rival companies tend to use branding with words like “driver assist.” Autopilot indicates, well, an autonomous pilot. California’s attorney general and the state’s Department of Motor Vehicles are also investigating Tesla for misleading branding and marketing.

Tesla, on the other hand, says that it warns customers that they need to pay attention while using Autopilot and FSD, according to The Verge. The company says the software features regular indicators that remind drivers to keep their hands on the wheels and eyes on the road. The NHTSA and other safety groups have said that these warnings do not go far enough and were “insufficient to prevent misuse.” Despite these statements by safety groups, CEO Elon Musk recently promised that the company will continue to go “balls to the wall for autonomy.”

The findings could only represent a small fraction of the actual number of crashes and accidents related to Autopilot and FSD. The NHTSA indicated that “gaps in Tesla’s telematic data create uncertainty regarding the actual rate at which vehicles operating with Autopilot engaged are involved in crashes.” This means that Tesla only receives data from certain types of crashes, with the NHTSA claiming the company collects data on around 18 percent of crashes reported to police.

With all of this mind, the organization has opened up another probe into Tesla. This one looks into a recent OTA software fix issued in December after two million vehicles were recalled. The NHTSA will evaluate whether the Autopilot recall fix that Tesla implemented is effective enough.

In November last year, Musk appeared to make the decision to reinstate Trump’s account based on the results of a Twitter poll. He asked people to vote on whether Trump should have access to his account returned. At the end of 24 hours, the option to reinstate the former president won with 51.8 percent of a decision that saw more than 15 million votes. Musk admitted at the time that some of the action on the poll came from “bot and troll armies.” Prior to the poll, Musk also said the decision on whether to reinstate Trump would come from a newly formed moderation council, but he never followed through on that pledge.

The website then known as Twitter banned Trump in early 2021 after he broke the company’s rules against inciting violence. The initial suspension saw Trump lose access to his account for 12 hours, but days later, the company made the decision permanent. At first, Trump tried to skirt the ban, even going so far as to file a lawsuit against Twitter that ultimately failed. Following his de-platforming from Twitter, Facebook and other social media websites, Trump went on to create Truth Social. Following his reinstatement, Trump said he didn’t “see any reason” to return to the platform. That said, the promise of reaching a huge audience with something as dramatic as a mug shot was obviously too good for Trump to pass up, particularly with what is likely to be a messy Republican primary on the horizon.

The two will have the unenviable task of leading X’s safety efforts, including its attempts to reassure advertisers that the platform doesn’t monetize hate speech or terrorist content. The company said earlier this year it planned to hire 100 new safety employees after previously cutting much of its safety staff.

Head of safety has been a particularly fraught position since Elon Musk took over the company previously known as Twitter. Musk has previously clashed with his safety leads and McRoberts is the third person to hold the title in less than two years. Previously, Yoel Roth resigned shortly after the disastrous rollout of Twitter Blue in 2022. Roth was replaced by Ella Irwin, who resigned last year after Musk publicly criticized employees for enforcing policies around misgendering.

Not much is known about McRoberts, but she is apparently an existing member of X’s safety team (her X account is currently private and a LinkedIn profile appears to have been recently deleted). “During her time at X, she has led initiatives to increase transparency in our moderation practices through labels, improve security with passkeys, as well as building out our new Safety Center of Excellence in Austin,” X said in a statement.

A subsequent tweet from X provided an explanation: Any accounts with over 2,500 verified (ie, paid Premium or Premium+ blue tick subscribers) get Premium features for free, and any with over 5,000 get the ad-free Premium+ tier, also gratis.

Prior to this, the only users to get free Premium blue checks have been those with large follower numbers (in the million range, minimum), along with celebrities and corporations/media companies. The new move appears to be a way to bring influential users with lower follower counts (journalists largely) into the fold.

So what prompted this? X may have decided it needs more journalists with blue checks. In the wake of recent events (the Taiwan earthquake, Turkey elections, Baltimore bridge collapse), some users complained that X is no longer the gold standard breaking news platform that Twitter used to be.

That's likely because journalists, who discover or amplify such news, have seen reduced prominence while X's algorithms amplify blue check content and replies. That means know-nothing or shitcoin promoters with 25 followers who paid 8 bucks will appear atop replies, rather than an experienced journalist who can furnish useful, truthful information.

With the blue check now being a mark of shame in many cases, a fair number of the users who regained one aren't necessarily happy about it. "Shit, I've been forcibly bluechecked. How do I opt out," wrote @emptywheel. "oh no," Katie Notopoulos tweeted. "I am become bluecheck, promoter of shibacoin."

The canceled entry-level EV project —often called “Model 2” — was reportedly codenamed “Redwood.” The automaker had predicted a weekly production volume of 10,000 vehicles, and Musk said, “We’ll be sleeping on the line” to make it a reality. He had previously claimed Tesla was working on two new EV models expected to sell up to five million units annually.

For nearly two decades, the CEO has described his long-term goal as using luxury vehicles to build Tesla’s brand before using those profits to fund budget models. “When someone buys the Tesla Roadster sports car, they are actually helping pay for development of the low cost family car,” Musk wrote in a 2006 “Secret Tesla Motors Master Plan” memo. In the following years, he often echoed those sentiments to customers and investors.

The cancellation would leave the $39,000 and up Model 3 sedan as Tesla’s cheapest vehicle. The scrapped budget model was expected to start at around $25,000.

Reuters’ sources told the outlet they were told about the cancellation in a late February meeting “attended by scores of employees.” The publication says it reviewed internal Tesla messages about the pivot, including one advising staff to hold off on telling suppliers “about program cancellation.” Other messages allegedly told staffers that “suppliers should halt all further activities related to H422/NV91,” referring to the budget model’s external and internal codenames.

Musk posted on X (Twitter) on Friday, “Reuters is lying (again)” in response to the story — without listing any points of contention.

Tesla has its work cut out for it. Not only has EV demand slowed in the US, but competition in China is fierce, with the fast-growing BYD leading the country’s entry-level market. The Chinese automaker said earlier this month that its sales increased 13 percent year over year. Meanwhile, Tesla said on Tuesday that its deliveries dropped eight percent annually while falling 20 percent from the previous quarter.
