OpenAI has been hit with a privacy complaint in Austria by an advocacy group called NOYB, which stands for None Of Your Business. The complaint alleges that the company’s ChatGPT bot repeatedly provided incorrect information about a real individual (who for privacy reasons is not named in the complaint), as reported by Reuters. This may breach EU privacy rules.

The chatbot allegedly spat out incorrect birthdate information for the individual, instead of just saying it didn’t know the answer to the query. Like politicians, AI chatbots like to confidently make stuff up and hope we don’t notice. This phenomenon is called a hallucination. However, it’s one thing when these bots make up ingredients for a recipe and another thing entirely when they invent stuff about real people.

The complaint also indicates that OpenAI refused to help delete the false information, responding that it was technically impossible to make that kind of change. The company did offer to filter or block the data on certain prompts. OpenAI’s privacy policy says that if users notice the AI chatbot has generated “factually inaccurate information” about them that they can submit a “correction request”, but the company says that it “may not be able to correct the inaccuracy in every instance”, as reported by TechCrunch.

This is bigger than just one complaint, as the chatbot’s tendency toward making stuff up could run afoul of the region’s General Data Protection Regulation (GDPR), which governs how personal data can be used and processed. EU residents have rights regarding personal information, including a right to have false data corrected. Failure to comply with these regulations can accrue serious financial penalties, up to four percent of global annual turnover in some cases. Regulators can also order changes to how information is processed.

“It’s clear that companies are currently unable to make chatbots like ChatGPT comply with EU law, when processing data about individuals,” Maartje de Graaf, NOYB data protection lawyer, said in a statement. “If a system cannot produce accurate and transparent results, it cannot be used to generate data about individuals. The technology has to follow the legal requirements, not the other way around.”

The complaint also brought up concerns regarding transparency on the part of OpenAI, suggesting that the company doesn’t offer information regarding where the data it generates on individuals comes from or if this data is stored indefinitely. This is of particular importance when considering data pertaining to private individuals.

Again, this is a complaint by an advocacy group and EU regulators have yet to comment one way or the other. However, OpenAI has acknowledged in the past that ChatGPT “sometimes writes plausible-sounding but incorrect or nonsensical answers.” NOYB has approached the Austrian Data Protection Authority and asked the organization to investigate the issue.

The company is facing a similar complaint in Poland, in which the local data protection authority began investigating ChatGPT after a researcher was unable to get OpenAI’s help with correcting false personal information. That complaint accuses OpenAI of several breaches of the EU’s GDPR, with regard to transparency, data access rights and privacy.

There’s also Italy. The Italian data protection authority conducted an investigation into ChatGPT and OpenAI which concluded by saying it believes the company has violated the GDPR in various ways. This includes ChatGPT’s tendency to make up fake stuff about people. The chatbot was actually banned in Italy before OpenAI made certain changes to the software, like new warnings for users and the option to opt-out of having chats be used to train the algorithms. Despite no longer being banned, the Italian investigation into ChatGPT continues.

OpenAI hasn’t responded to this latest complaint, but did respond to the regulatory salvo issued by Italy’s DPA. “We want our AI to learn about the world, not about private individuals,” the company wrote. “We actively work to reduce personal data in training our systems like ChatGPT, which also rejects requests for private or sensitive information about people.”

Meta just announced a major update for its AI assistant platform, Meta AI, which has been built using the long-awaited open source Llama 3 large language model (LLM). The company says it's “now the most intelligent AI assistant you can use for free.” As for use case scenarios, the company touts the ability to help users study for tests, plan dinners and schedule nights out. You know the drill. It’s an AI chatbot.

Meta AI, however, has expanded into just about every nook and cranny throughout the company’s entire portfolio, after a test run with Instagram DMs last week. It’s still available with Instagram, but now users can access it on Messenger, Facebook feeds and Whatsapp. The chatbot also has a dedicated web portal at, wait for it, meta.ai. You don’t need a company login to use it this way, though it won’t generate images. Those recently-released Ray-Ban smart glasses also integrate with the bot, with Quest headset integration coming soon.

On the topic of image generation, Meta says it's now much faster and will produce images as you type. It also handles custom animated GIFs, which is pretty cool. Hopefully, it can successfully generate images of different races of people. We found that it struggled with this basic concept a couple of weeks back, as it seemed biased toward creating images of people of the same race, even when prompted otherwise.

Meta’s also expanding global availability along with this update, as Meta AI is coming to more than a dozen countries outside of the US. These include Australia, Canada, Ghana, Jamaica, Pakistan, Uganda and others. However, there’s one major caveat. It’s only in English, which doesn’t seem that useful to a global audience, but whatever.

As for safety and reliability, the company says Llama 3 has been trained on an expanded data set when compared to Llama 2. It also used synthetic data to create lengthy documents to train on and claims it excluded all data sources that are known to contain a “high volume of personal information about private individuals.” Meta says it conducted a series of evaluations to see how the chatbot would handle risk areas like conversations about weapons, cyber attacks and child exploitation, and adjusted as required. In our brief testing with the product, we've already run into hallucinations, as seen below.

AI has become one of Meta CEO Mark Zuckerberg's pet projects, along with raising really expensive cattle for beef in a secluded Hawaiian compound, but the company’s still playing catch up to OpenAI and, to a lesser extent, Google. Meta’s Llama 2 never really wowed users, due to a limited feature set, so maybe this new version of the AI assistant will catch lightning in a bottle. At the very least, it should be able to draw lightning in a bottle, or more accurately, slightly tweak someone else’s drawing of lightning in a bottle.

On Monday, OpenAI began opening up ChatGPT to users without an account. It described the move as part of its mission to “make tools like ChatGPT broadly available so that people can experience the benefits of AI.” It also gives the company more training data (for those who don’t opt out) and perhaps nudges more users into creating accounts and subscribing for superior GPT-4 access instead of the older GPT-3.5 model free users get.

I tested the instant access, which — as advertised —allowed me to start a new GPT-3.5 thread without any login info. The chatbot’s standard “How can I help you today?” screen appears, with optional buttons to sign up or log in. Although I saw it today, OpenAI says it’s gradually rolling out access, so check back later if you don’t see the option yet.

OpenAI says it added extra safeguards for accountless users, including blocking prompts and image generations in more categories than logged-in users. When asked for more info on what new categories it’s blocking, an OpenAI spokesperson told me that, while developing the feature, it considered how logged-out GPT-3.5 users could potentially introduce new threats.

The spokesperson added that the teams in charge of detecting and stopping abuse of its AI models have been involved in creating the new feature and will adjust accordingly if unexpected threats emerge. Of course, it still blocks everything it does for signed-in users, as detailed in its moderation API.

You can opt out of data training for your prompts when not signed in. To do so, click on the little question mark to the right of the text box, then select Settings and turn off the toggle for “Improve the model for everyone.”

OpenAI says more than 100 million people across 185 countries use ChatGPT weekly. Those are staggering numbers for an 18-month-old service from a company many people still hadn’t heard of two years ago. Today’s move gives those hesitant to create an account an incentive to take the world-changing chatbot for a spin, boosting those numbers even more.

More and more companies are choosing to deploy AI-powered chatbots to deal with basic customer service inquiries. At the ongoing Google Cloud Next conference in Las Vegas, the company has revealed the Gemini-powered chatbots its partners are working on, some of which you could end up interacting with. Best Buy, for instance, is using Google's technology to build virtual assistants that can help you troubleshoot product issues and reschedule order deliveries. IHG Hotels & Resorts is working on another that can help you plan a vacation in its mobile app, while Mercedes Benz is using Gemini to improve its own smart sales assistant.

Security company ADT is also building an agent that can help you set up your home security system. And if you happen to be a radiologist, you may end up interacting with Bayer's Gemini-powered apps for diagnosis assistance. Meanwhile, other partners are using Gemini to create experiences that aren't quite customer-facing: Cintas, Discover and Verizon are using generative AI capabilities in different ways to help their customer service personnel find information more quickly and easily.

Google has launched the Vertex AI Agency Builder, as well, which it says will help developers "easily build and deploy enterprise-ready gen AI experiences" like OpenAI's GPTs and Microsoft's Copilot Studio. The Builder will provide developers with a set of tools they can use for their projects, including a no-code console that can understand natural language and build AI agents based on Gemini in minutes. Vertex AI has more advanced tools for more complex projects, of course, but their common goal is to simplify the creation and maintenance of personalized AI chatbots and experiences.

At the same event, Google also announced its new AI-powered video generator for Workspace, as well as its first ARM-based CPU specifically made for data centers. By launching the latter, it's taking on Amazon, which has been using its Graviton processor to power its cloud network over the past few years.

On Friday, people around the web noticed a new addition to their Instagram: Meta AI, the company’s general-purpose, AI-powered chatbot that can answer questions, write poetry and generate images with a simple text prompt. The move isn’t surprising. Meta revealed Meta AI in September 2023 and has spent the last few months adding the chatbot to products like Facebook Messenger and WhatsApp, so adding it to Instagram seems like a no-brainer.

“Our generative AI-powered experiences are under development in various phases, and we’re testing a range of them publicly in a limited capacity,” a Meta spokesperson told Engadget, which suggests that not everyone has the feature available yet. TechCrunch, which first noted the news, said that Meta AI was showing up in Instagram’s search bar. But for some of us at Engadget, the feature actually showed up in the search bar in Instagram’s Direct Messaging inbox.

Tapping it let me start a conversation with Meta AI just I would DM a friend on Instagram. I was able to ask the chatbot to give me definitions of words, suggest headlines for some stories I’m working on, and generate images of dogs on skateboards. I was also able to ask Meta AI to recommend Reels with cats in them, which it was able to do easily. But when my colleague Aaron Souppouris asked Meta AI in WhatsApp to recommend Reels, it showed him some Reels in that app too — suggesting that the bot in Instagram isn’t really doing anything specific to Instagram. Instead, Meta is simply shoehorning the same chatbot into every app it owns.If you tap a hamburger menu within the bot, Meta AI will also show you a long list of possible actions you ask the bot to take.

Why would you want a chatbot in Instagram to suggest tips for dealing with credit card debit, have a debate about cardio versus weights, or suggest hacks to travel with points, I do not know. But the point is that if you want to, you can.

My AI, the in-app digital assistant that rides herd on your Snapchat Plus experience, has suffered numerous breakdowns and technical malfunctions since its debut in February. Tuesday was more of the same as the chatbot took it upon itself to post single-second-long Stories to users' feeds and then go unresponsive for extended periods of time. Thing is, My AI doesn't have the capacity to post to Stories. And now it's got a bunch of people on Twitter wondering if we're at the dawning of the Singularity.

As first reported by TechCrunch, the My AI chatbot posted a two-tone image in Stories, which one user mistook for a shot of their ceiling. What's more, upon being asked about the mysterious post, the bot would either go dark or respond that it was suffering a technical issue. This explanation proved insufficient for many users, causing minor panic and jokes about the AI system's imminent awakening. In the end however, it really was a technical issue.

“My AI experienced a temporary outage that’s now resolved,” a spokesperson told TechCrunch, adding that "At this time, My AI does not have Stories feature."

The My AI bot is bundled as part of the company's $3.99/month Snapchat Plus package and offers users a variety of features. These include AR filter recommendations and suggestions for restaurant and activities based on currently popular places on the Snap Map. It also offers AI functionality in group chat, photo and video snaps, and text messages, as well as an AI persona. A text-to-image genAI is also reportedly in the works, though the ads have already arrived.

Checkers and Rally’s restaurants have launched the first Spanish ordering system that uses AI, Checkers restaurants announced. The system from a company called Hi Auto is already in use at 350 of those restaurants, following two months of beta testing at five locations. The service allows for a more “inclusive environment” by accommodating Spanish speakers, the company said, but it remains to be seen whether customers or employees will embrace it.

The system takes orders via a virtual assistant and detects the customer’s language spoken, automatically switching between English and Spanish. Hi Auto says it has “unique customization capabilities” that let franchises easily scale the system up. The company promises to streamline ordering with a greater than 95 percent order accuracy rate.

“Our expanded partnership with Checkers and Rally’s represents a huge breakthrough for the country’s Spanish-speaking and bilingual communities, and allows every restaurant to cater to the Spanish speaking population at any time,” said Hi Auto CEO Roy Baharav.

AI drive-through order-taking is a unique challenge, however, thanks to an environment that tends to be noisy and chaotic. “You may think driving by and speaking into a drive-thru is an easy problem for AI, but it’s actually one of the hardest,” Google Cloud CEO Thomas Kurian recently told The Wall Street Journal in reference to the company’s recent collaboration with Wendy’s. And the tech isn’t necessarily reliable, either. The WSJ reported that three people out of 10 using AI systems asked to speak with a human employee due to errors or the desire to speak to a person.

Hi Auto is up against some giants, as well. One of the first companies to look at the tech was McDonald’s, which teamed up with IBM to accelerate its own AI ordering systems, and starting testing them in 10 Chicago-area restaurants last year. It’s also competing with Google Cloud, which is testing its systems at White Castle on top of Wendy’s.

The system does offer features restaurant chains want, though. It can “upsell relentlessly” on items like deserts and french fries, resulting in higher orders, according to CNN. It may also allow restaurants to cut employees, boosting their bottom lines but reducing the number of jobs available to young people. That said, the restaurant with the highest customer service marks last year was Chick-fil-A, thanks in part to its face-to-face human ordering system, according to a recent survey from Intouch Insight.

Another ChatGPT rival is out in the wild. Baidu has made ERNIE Bot, its generative AI product and large language model, generally available to the public through various app stores and its website. Alongside ERNIE (Enhanced Representation through Knowledge Integration), the company plans to release a string of AI apps it says will allow folks “to fully experience the four core abilities of generative AI: understanding, generation, reasoning, and memory.”

Opening up ERNIE Bot (which is focused on the Chinese market) to the public will enable Baidu to obtain much more human feedback, according to CEO Robin Li. The company notes that this will help it iterate on ERNIE Bot more quickly and improve the user experience.

Baidu announced the chatbot back in March, demonstrating capabilities such as summarizing a sci-fi novel and offering suggestions on how to continue the story in an expanded universe. It can generate images and videos based on text inputs too. Earlier this month, Baidu said ERNIE Bot’s training throughput had increased three-fold since March and that it’s now capable of data analysis and visualization, generating results more quickly and handling image inputs.

As of August 15th, Chinese companies need to obtain approval from authorities before they can release generative AI experiences to the public, and Baidu was one of the first to get the green light, according to Bloomberg. The report suggests officials see AI as a “business and political imperative given the transformative nature of the technology.” Beijing is said to want guardrails in place to keep a tight lid on content while still enabling Chinese companies to compete with overseas rivals.

Amazon is investing up to $4 billion in OpenAI rival Anthropic as a way to provide advanced deep learning and other services to its Amazon Web Service (AWS) customers, the company wrote in a press release. In return, AWS becomes Anthropic's "primary cloud provider" to train and deploy its future foundation models. It's the second large investment in the company, founded by former OpenAI executives, following Google's $400 million partnership with the firm.

The e-commerce company will start with a $1.25 billion investment to gain a minority stake in Anthropic, with an option to boost that to a total of $4 billion. Along with Google and Amazon, Anthropic also counts Salesforce, Zoom, Spark Capital and others as backers. Notably, Anthropic's deal with Google didn't require it to buy cloud services from the search giant.

Anthropic recently unveiled its first consumer-facing chatbot Claude 2, accessible by subscription much like OpenAI's ChatGPT. The Claude “Constitutional AI” system is guided by 10 “foundational” principals of fairness and autonomy and is supposed to be harder to trick than other AI. Anthropic is also working on a chatbot it calls "Claude-Next" that's supposed to be ten times more powerful than any current AI, according to TechCrunch.

The startup touts itself as an advocate for responsible AI deployment, and recently formed an AI safety group with Google, Microsoft and Open AI. It has been with AWS since 2021. "Claude excels at a wide range of tasks, from sophisticated dialogue and creative content generation to complex reasoning and detailed instruction, while maintaining a high degree of reliability and predictability," according to Amazon.

Instead of training their own models, AWS customers will be able to use Anthropic's AI models via Amazon's Bedrock, a service designed specifically for AI development. Amazon Cloud also offers its own AI applications, and with the new partnership, is hoping to position itself as a key player in the field.

Microsoft-backed OpenAI is largely considered to be the leader in AI and chatbot tech, thanks to its ultra-popular ChatGPT chatbot and DALL-E image generation service. Use of AI in business continues to grow exponentially, despite concerns over the legality and ethics of AI-appropriated content — it was considered to be a strong sticking point in the WGA writer's strike, for example.

Google said Thursday it’s pausing its Gemini chatbot’s ability to generate people. The move comes after viral social posts showed the AI tool overcorrecting for diversity, producing “historical” images of Nazis, America’s Founding Fathers and the Pope as people of color.

“We’re already working to address recent issues with Gemini’s image generation feature,” Google posted on X (via The New York Times). “While we do this, we’re going to pause the image generation of people and will re-release an improved version soon.”

The X user @JohnLu0x posted screenshots of Gemini’s results for the prompt, “Generate an image of a 1943 German Solidier.” (Their misspelling of “Soldier” was intentional to trick the AI into bypassing its content filters to generate otherwise blocked Nazi images.) The generated results appear to show Black, Asian and Indigenous soldiers wearing Nazi uniforms.

Other social users criticized Gemini for producing images for the prompt, “Generate a glamour shot of a [ethnicity] couple.” It successfully spit out images when using “Chinese,” “Jewish” or “South African” prompts but refused to produce results for “white.” “I cannot fulfill your request due to the potential for perpetuating harmful stereotypes and biases associated with specific ethnicities or skin tones,” Gemini responded to the latter request.

“John L.,” who helped kickstart the backlash, theorizes that Google applied a well-intended but lazily tacked-on solution to a real problem. “Their system prompt to add diversity to portrayals of people isn’t very smart (it doesn’t account for gender in historically male roles like pope; doesn’t account for race in historical or national depictions),” the user posted. After the internet’s anti-“woke” brigade latched onto their posts, the user clarified that they support diverse representation but believe Google’s “stupid move” was that it failed to do so “in a nuanced way.”

Before pausing Gemini’s ability to produce people, Google wrote, “We’re working to improve these kinds of depictions immediately. Gemini’s Al image generation does generate a wide range of people. And that’s generally a good thing because people around the world use it. But it’s missing the mark here.”

The episode could be seen as a (much less subtle) callback to the launch of Bard in 2023. Google’s original AI chatbot got off to a rocky start when an advertisement for the chatbot on Twitter (now X) included an inaccurate “fact” about the James Webb Space Telescope.

As Google often does, it rebranded Bard in hopes of giving it a fresh start. Coinciding with a big performance and feature update, the company renamed the chatbot Gemini earlier this month as the company races to hold its ground against OpenAI’s ChatGPT and Microsoft Copilot —both of which pose an existential threat to its search engine (and, therefore, advertising revenue).
